IMO this should be a proposed rule since it impacts the entire US and definitely has an economic impact in excess of the $100 million trigger required for full economic analysis by the agency and the OIRA at OMB led by Cass Sunstein.
This is the most important policy issue to be addressed by FEMA in the last two decades.
